This Privacy Policy describes how Contour Realty, Inc. (“Contour Realty,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information through our website, contourrealty.com (the “Site”), and in connection with the real estate brokerage services we provide in Ventura, Los Angeles, and Santa Barbara counties (collectively, the “Services”). Our Services are intended for U.S. residents.

By using the Site or Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

This Privacy Policy applies to personal information we collect through the Site and in the course of providing the Services, and to information collected offline (for example, during a real estate transaction) that we combine with information collected online.

“Affiliates” refers to our affiliated companies, including Summit Financial Network, Inc., Summit Mortgage and Investment Co., and Summit Property Management (collectively, the “Summit Affiliates”). If you engage a Summit Affiliate for mortgage, lending, or property management services, additional privacy notices from that Affiliate may apply, including federally required financial privacy notices under the Gramm-Leach-Bliley Act where applicable.

Our real estate agents are independent contractors. This Privacy Policy does not govern your interactions with agents outside the Site or with third-party websites, tools, or services that you access through links on the Site. We encourage you to review the privacy policies of any third-party services you use.

Information you provide directly:

• Contact information: Name, email address, phone number, and mailing address when you submit a contact form, request information about a property, request a home valuation, or otherwise communicate with us.
• Property and transaction inquiries: Property address, property details, and information about your buying, selling, or renting goals, including price range, timing, and financing status.
• Property search accounts: If you register for an account on our MLS property search, we collect login credentials, saved searches, saved/favorited listings, and search preferences.
• Transaction information: If you become a client, we may collect information necessary to complete a transaction, which can include financial information (such as pre-approval letters, proof of funds, and lender information), government-issued identification, and information contained in purchase agreements, listing agreements, leases, and related documents. Much of this information is collected offline or through third-party transaction platforms.

Information collected automatically:

• Usage and device data: IP address, browser type, device type, operating system, referring URLs, pages viewed, listings viewed, and dates/times of access.
• Cookies and similar technologies: We and our service providers use cookies, pixels, and similar technologies to operate the Site, remember preferences, power the MLS/IDX property search, and analyze Site traffic. You can control cookies through your browser settings; disabling cookies may limit some Site features, including saved property searches.

Information from third parties:

• MLS / IDX data: Property listing data displayed on the Site is provided through an IDX feed from the Conejo Simi Moorpark Association of REALTORS® multiple listing service (CSMAR MLS), powered by FBS Products (Flexmls). Your interactions with the property search may be processed by that provider.
• Affiliates and transaction parties: We may receive information about you from our Affiliates, from other parties to a transaction (such as escrow, title, and lending companies), and from publicly available sources such as county property records.

We use personal information to:

• Respond to your inquiries and provide the real estate services you request, including property searches, showings, valuations, and transaction management.
• Facilitate the purchase, sale, lease, or management of real property, including coordinating with lenders, escrow and title companies, inspectors, appraisers, and other transaction participants.
• Create and manage your property search account, including saved searches and listing alerts.
• Send you communications you have requested, such as listing updates, market reports, and newsletters. You may opt out of marketing communications at any time.
• Operate, maintain, secure, and improve the Site and Services, including analytics and debugging.
• Comply with legal, regulatory, and record-keeping obligations, including California Department of Real Estate record-retention requirements, and to enforce our agreements and protect our rights.

We do not sell your personal information for monetary compensation, and we do not use your personal information for automated decision-making that produces legal or similarly significant effects.

We may share personal information with:

• Our agents: Our independent-contractor real estate agents, so they can respond to your inquiries and provide brokerage services to you.
• Affiliates: The Summit Affiliates, where relevant to services you request (for example, mortgage pre-approval through Summit Mortgage and Investment Co., or rental management through Summit Property Management).
• Service providers: Vendors that perform services on our behalf, such as website hosting, the FBS Products (Flexmls) IDX search platform, email delivery, analytics, customer relationship management, and transaction management platforms. These providers are permitted to use your information only to perform services for us.
• Transaction participants: When you are a party to a real estate transaction, we share information as needed with the other parties and professionals involved, including cooperating brokers and agents, lenders, escrow and title companies, appraisers, inspectors, and attorneys.
• MLS and listing syndication: If you list a property for sale with us and choose to market it publicly, we are generally required to submit the listing to the MLS. The MLS distributes listing data (including the property address, photos, and listing details) to other brokerages and real estate portals such as Zillow and Redfin. This distribution is governed by MLS rules and cannot be opted out of while the property is publicly listed.
• Legal compliance and protection: We may disclose information to comply with applicable law, regulation, subpoena, or governmental request; to enforce our agreements; or to protect the rights, property, or safety of Contour Realty, our clients, or others, including for fraud prevention.
• Business transfers: If we are involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction.

By providing your telephone number to us through the Site or otherwise, you expressly consent to receive calls and text (SMS/MMS) messages from Contour Realty and our agents at that number regarding your inquiry, property searches, and transactions. Such contact may include calls or texts placed using automated dialing technology or prerecorded or artificial voice, even if your number is on a corporate, state, or the National Do Not Call Registry. Consent is not a condition of purchasing any property, good, or service.

Message frequency varies, and message and data rates may apply; contact your wireless provider with questions about your plan. Wireless carriers are not liable for delayed or undelivered messages. You may opt out of text messages at any time by replying STOP to any message; we will send a single message confirming your opt-out. Reply HELP for assistance, or contact us using the information in Section 13. To opt out of voice calls, tell the caller you no longer wish to receive calls or contact us directly. Mobile phone numbers and text-message opt-in data will not be shared with third parties or affiliates for their marketing or promotional purposes.

Email, text messages, and other electronic communications are neither secure nor confidential, and email accounts of parties to real estate transactions are frequent targets of criminals. CONTOUR REALTY WILL NEVER SEND YOU AN EMAIL OR TEXT MESSAGE WITH WIRE TRANSFER INSTRUCTIONS OR A REQUEST FOR NONPUBLIC PERSONAL INFORMATION SUCH AS CREDIT OR DEBIT CARD NUMBERS OR BANK ACCOUNT OR ROUTING NUMBERS.

If you receive any electronic communication directing you to wire funds or provide financial account information — even if it appears to come from Contour Realty, our agents, our Affiliates, or your escrow or title company — do not respond to it. Verify all wire instructions in person or by telephone using a number you have independently confirmed, before sending any funds. To report suspected fraud related to your transaction, contact us immediately using the information in Section 13.

• Email: You may opt out of marketing emails by clicking the “unsubscribe” link in any marketing email or by contacting us using the information below. We may still send transactional or service-related communications.
• Text messages: Reply STOP to any text message to opt out of texts.
• Cookies: Most browsers allow you to refuse or delete cookies. See Section 2 for the effect on Site features.
• Account information: If you have a property search account, you can update your saved searches and preferences within the account, or contact us to close the account.

Depending on the volume of personal information we process and other statutory thresholds, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) may apply to our processing of your personal information. Regardless of statutory applicability, California residents may submit the following requests, which we will honor to the extent required by law:

• The right to know the categories and specific pieces of personal information we have collected about you, the sources of that information, our purposes for collecting it, and the categories of third parties with whom we have shared it.
• The right to request deletion of your personal information, subject to exceptions (for example, information we must retain to complete a transaction or to comply with real estate record-keeping laws).
• The right to correct inaccurate personal information.
• The right to opt out of the sale or sharing of personal information. We do not sell personal information for monetary compensation and do not share personal information for cross-context behavioral advertising.
• The right not to be discriminated against for exercising your privacy rights.

To submit a request, contact us using the information in Section 13. We will verify your identity before fulfilling a request, which may require you to provide information we can match against our records. You may designate an authorized agent to submit a request on your behalf; we will require written proof of the agent’s authority and may require you to verify your identity directly with us.

Response timing: We will acknowledge receipt of a verifiable request within 10 business days and respond within 45 calendar days, which we may extend once by an additional 45 days where reasonably necessary, with notice to you. You may submit a request to know up to twice within a 12-month period. We do not charge a fee to process requests unless a request is excessive, repetitive, or manifestly unfounded, in which case we will explain our decision and provide a cost estimate before completing the request.

For your protection, we will not disclose in response to an access request your Social Security number, driver’s license or other government identification number, financial account numbers, account passwords, or security questions and answers, even if we hold such information.

Shine the Light: Under California Civil Code Section 1798.83, California residents may request certain information about our disclosure of personal information to third parties for those third parties’ direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

Do Not Track: Some browsers transmit “Do Not Track” signals. The Site does not currently respond to Do Not Track signals.

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services and comply with legal obligations. California law requires real estate brokers to retain transaction records for at least three years; we may retain transaction-related information longer where prudent for legal or tax purposes. Website inquiry and marketing data is retained until you request deletion or it is no longer needed.

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials and for limiting access to your devices.

The Site and Services are not directed to children. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us personal information, contact us and we will delete it.

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above and post the updated policy on the Site. If we make material changes, we will provide notice commensurate with the significance of the change. Your continued use of the Site after an update constitutes acceptance of the revised policy.
